Advising and supporting you through ACAS Conciliation
A dedicated, supportive Employment Legal Service guiding you through your employment needs.
Who is ACAS?
The Advisory, Conciliation and Arbitration Service (ACAS) is an independent public body that provides impartial information and conciliation services in relation to workplace disputes.
What is the ACAS Early Conciliation process?
Why is ACAS Early Conciliation increasingly significant?
ACAS Early Conciliation has an increasingly important role for schools and academy trusts. Changes introduced under the Employment Rights Act 2025 mean that the time limit for bringing most Employment Tribunal claims has increased from three months to six months. Separately, from 1 January 2027, the qualifying period for ordinary unfair dismissal protection will reduce from two years to six months. Together, these changes will significantly increase both the number of employees who may be eligible to bring an ordinary unfair dismissal claim and the period during which a potential dispute may remain live.
Together with the Early Conciliation period, these changes create an important opportunity for schools and academy trusts to assess legal and commercial risk, preserve evidence, review the process followed and explore a proportionate resolution before positions become entrenched and the cost and management time associated with Tribunal proceedings increase
What happens if ACAS Early Conciliation is successful?
Where the parties reach a resolution with ACAS involvement, the agreed terms will usually be recorded in a COT3 agreement. Legal Connect can advise on the proposed terms and draft or review the COT3 before the settlement is confirmed through ACAS.
What happens if ACAS Early Conciliation is not successful?
If resolution is not reached, or the parties do not wish to participate in conciliation, ACAS will issue an Early Conciliation certificate. The individual may then be able to present the relevant claim to the Employment Tribunal, subject to the applicable time limit and procedural requirements.
How can Legal Connect help you?
Legal Connect can assess the allegations and potential claims, review the underlying HR process, identify procedural, discrimination or whistleblowing risks, consider likely remedies and costs, and advise whether informal resolution, continued management action, negotiated settlement or defence of potential proceedings is the most appropriate strategy.
We can also advise on negotiation strategy, liaise with ACAS on your behalf and represent your interests throughout the conciliation process
